These Terms of Service ("Terms") govern your use of southernnannycompany.com and related Southern Nanny Company services, including our family and nanny forms, nanny recruitment services, Nanny in a Box digital product, and client portal. By using the website or purchasing or using a service, you agree to these Terms and any additional written agreement that applies to the specific service.
1. Eligibility & Acceptance
You must be at least 18 years old and legally capable of entering into an agreement to purchase products, request recruitment services, submit a nanny application, or use the client portal. If you use our services on behalf of another person or organization, you represent that you are authorized to do so.
2. Southern Nanny Company Services
Southern Nanny Company provides childcare recruiting, placement support, babysitting-related services, family and nanny application processes, digital educational products, and related support. Submitting a form, paying an initial fee, purchasing a digital product, or participating in an interview does not guarantee that a specific nanny will be available, hired, or successfully placed.
Specific placement terms, replacement provisions, refund terms, timelines, responsibilities, or guarantees may be stated in a separate signed agreement. If a signed service agreement conflicts with these website Terms, the signed service agreement controls for that service.
3. Nanny in a Box
Price: $499, unless a different price is clearly displayed before purchase.
Nanny in a Box is a digital, self-paced educational course and toolkit that may include videos, PDFs, templates, checklists, hiring guidance, employment agreement guidance, compensation guidance, candidate-sourcing strategies, resume/profile review guidance, onboarding resources, and other digital materials. Access is provided through the Southern Nanny Company client portal after a completed purchase.
The product currently includes one background check coordinated through Checkr via the Southern Nanny Company client portal. Additional background checks are currently $50 each. Background-check availability, scope, turnaround time, and report content are subject to Checkr's services and applicable law.
Nanny in a Box provides educational and organizational guidance. It is not legal, tax, payroll, accounting, or human-resources advice, and it does not guarantee that you will find, hire, retain, or successfully employ a nanny.
4. Done For You Nanny Recruitment
The Done For You Nanny Recruitment Service currently begins with a $300 search-start fee. The initial fee starts the recruiting process, including candidate sourcing, vetting, and initial interviews or similar early-stage recruiting work.
After a family and nanny have entered into the applicable agreement and the nanny has been brought onboard, a placement fee equal to 10% of the nanny's annual salary is due. The applicable signed recruitment or placement agreement may contain additional details about calculating the annual salary, payment timing, replacements, cancellations, or other placement terms.
5. Background Checks & Screening
Background checks may be provided by Checkr or another authorized consumer reporting agency. Candidates must complete any required disclosures, consent, identity verification, and authorization steps before a report is ordered. Southern Nanny Company may facilitate access to screening, but the family or other lawful decision-maker remains responsible for deciding whether and how to use screening information and for complying with laws that apply to employment decisions.
A background report cannot guarantee that a person has no disqualifying history, will perform satisfactorily, or will never engage in harmful conduct. Screening should be considered alongside interviews, references, qualifications, and the family's own judgment.
6. Payments, Checkout & Refund Terms
Online product and service payments are planned to be processed through Stripe. Until Stripe checkout is enabled, disabled or grayed-out purchase buttons do not create a purchase, reservation, or obligation to provide a product or service.
When checkout is enabled, you agree to provide accurate billing information and authorize the applicable charges shown at checkout or in your signed agreement. Refund, cancellation, replacement, and payment terms, if applicable, will be stated at checkout or in the written agreement that applies to the product or service. We will not retroactively change fees for a purchase already completed.
7. Family & User Responsibilities
You are responsible for providing accurate information, conducting appropriate interviews, evaluating candidates, complying with household-employment obligations, and making the final hiring decision. Nothing on this website alone creates an employment relationship between Southern Nanny Company and a caregiver. The applicable placement or employment agreement should identify the parties' respective roles.
You may not use Southern Nanny Company services to discriminate unlawfully, harass candidates, evade legally required screening procedures, obtain reports without a lawful purpose or proper authorization, or use candidate information for an unauthorized purpose.
8. Intellectual Property & Digital Product License
Southern Nanny Company owns or licenses the website design, course materials, videos, PDFs, templates, branding, graphics, written content, and other materials made available through our services, except where otherwise stated.
A Nanny in a Box purchase grants the purchasing household a limited, non-exclusive, non-transferable license to use the materials for its own personal nanny search and household hiring process. You may not resell, sublicense, publicly post, share account access, reproduce for commercial distribution, or create competing products from the materials without written permission.
9. Client Portal & Account Security
You are responsible for maintaining the confidentiality of your client portal credentials and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
10. Disclaimers
To the fullest extent permitted by law, the website, digital products, recruiting support, candidate information, and related services are provided on an "as available" basis. We do not warrant that every candidate, background report, reference, course recommendation, or placement will be error-free, complete, continuously available, or suitable for every family.
Parents and guardians remain responsible for supervising their household, assessing caregiver fit, and making safety and employment decisions. Southern Nanny Company does not guarantee future conduct by any caregiver or family.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Southern Nanny Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or services. Any limitation or allocation of liability in a signed service agreement will apply to that service and will control if it conflicts with this section.
12. Third-Party Services
Checkr, Stripe, hosting providers, and other third-party services are independent providers. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party outages, changes, or acts outside our reasonable control.

14. Governing Law
These website Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable law requires otherwise. A separate signed agreement may contain additional dispute-resolution or venue provisions.
15. Changes to These Terms
We may update these Terms prospectively as our products, payment systems, or services change. The "Last updated" date above identifies the current version. Changes do not alter fees or obligations already fixed by a completed purchase or signed agreement unless both parties agree or applicable law permits otherwise.
